India publishes Drugs Medical Devices and Cosmetics Bill

The Ministry of Health and Family Welfare, Government of India has published a draft of New Drugs, Medical Devices and Cosmetics Bill, 2022 for the suggestions/ comments/ objections from the public/ stakeholders with regard to the said draft bill.

The Indian Drug Regulatory System is governed through The Drugs and Cosmetics Act, 1940. This act is a pre-independence legislation enacted by Central Legislative Assembly. As a part of continuous improvement, many steps are being taken by the Government of India like obsoleting and updating the existing laws. The Government of India intends to review the old provisions laid under the Act and periodically repeal and amend laws.

In view of above, the Government of India had took up the task of reviewing and updating the Drugs and Cosmetics Act, 1940. A committee was constituted for framing the New Drugs, Medical Devices and Cosmetics Bill, 2022. In order to keep pace with the changing needs, times, technology etc., the committee has drafted a bill.

The said bill has now been shared by the Government of India in public domain and has invited suggestions/ comments/ objections from the public/ stakeholders with regard to the draft bill within 45 days from the date of issue of notice i.e. 08.07.2022.
